I’d get with your spouse and ask them if they’d go in with you on hiring a single mediator before you lawyer up and file.
If either of you lawyers up and files, then they’ll bleed your household dry and drag out the divorce as long as possible, all in the name of “giving you the best possible representation”. This is taking food out of your kids’ mouth.
For your kids’ sake, hire a mediator first.
This is correct. Ignore person below who probably did just the opposite and had a bad attorney (and bad attorneys who want to drain your bank account are out there). Try to be as civil as possible for the kids and use a mediator.
This is not accurate. I had a much different experience. Talk to a lawyer, see what they say. Ask them how it will go. Hold them to what they estimate. Most importantly, be fucking reasonable. You’re not getting more than half the money, and custody/child support is pretty easy if you put your children first. The reason people’s divorce drags out and money gets depleted is that they are just able to compromise. SO NOT let your ego/feelings get in the way.
Feels like the prisoners dilemma here. If you both agree to mediation it is best. If one then lawyers up and files, the other is in a really bad spot. If both lawyer up then they are both equally screwed.
Monica Baca is excellent. Walks you through everything, is careful with how your retainer is spent, and doesn’t make a meeting out of an email.
Dorene Kuffer is pretty much the opposite.
I paid a flat fee to Charles Scott, it's nice to email or call and not have to worry about getting nickeled and dimed. Meanwhile my soon to be ex has paid so much to NM Law Group that she is begging for a mediator now, after passing MSA offers back and forth just a couple times. Her lawyer definitely gave her ideas that made extra, unnecessary work.
If your work has an employee assistance program, call that number and ask for a lawyer through that program. They will usually provide you free 1 hour long consultations for free, and often if you don’t like the first lawyer, they will provide you another referral
It’s only that simple if abuse isn’t involved. If there is, a lawyer can help force temporary domestic orders that provide support throughout the process, and they can help negotiate a more fair settlement because the toxic dynamic is not at play. It’s awesome when people can do it with just the forms, but there are times when a lawyer is vital.
Even if everything is totally amicable and there are no children, always use a mediator. Filing court forms for anyone who doesn’t do it regularly is a nightmare and it’s very easy to screw up if you don’t know local court procedures, legal terminology, etc. And very few understand the difference between a copy and a certified copy. I just would not suggest it. It’s too important a document (Judgment of Divorce).

I second that!

Second for Monica Baca. She's great.
She’s great if you want to drag it out for a long time.

I got divorced in NM without a lawyer. Just download the forms.
Yeah, it’s just that simple. Especially when you have children🙄

I used NM Divorce and custody law LLC 505- 431-4716. Had a good experience with this office.
Do not hire Barbara Johnson.
Armand Carian.
Joyce Gentry. Expensive but worth it
