They have quasi legislative powers, they can make their own rules, they are presumed the experts armed with field experience. Theres no prohibitory law, and theres no positive law mandating the same.
If the pnp feels it is best to file a case whenever someone dies, and they merely forward the facts and evidence, that makes sense. Because why would anyone want the pnp to determine whether one has a committed a crime, that is a conclusion of law best left to the fiscal.
Filing a case merely initiates criminal procedure, but it does not mean it will commence.

Similar thing happened to my brother years ago. Motorcycle rider died when he crashed to my brother's car while the mc rider is beating a red light, all things considered including witnesses and cctv footage, cleared ang kuya ko as per the police officers, my kuya was held in the police custody (not jail) for a couple of hours just for legal documentation. What sped it up was my kuya's lawyer, he was able to acquire all the evidence within the first couple hours, the cctv footage from the traffic office, pulled the witnesses to the police station as well. My kuya was even told that he can file for damages sa car niya since insured yung mc din but he took up his own insurance nlang out of courtesy sa rider and his fam.
Dapat tinakot man lang ng kuya mo para mag tino. Kaya namimihasa ibang rider sa dahilan na "mahirap lang po kami" as a get out of jail free card

Mali magsampa nang case because? anong legal basis mo? or are you just talking about morality? They have quasi legislative powers, they can make their own rules, they are presumed the experts armed with field experience. Theres no prohibitory law, and theres no positive law mandating the same. If the pnp feels it is best to file a case whenever someone dies, and they merely forward the facts and evidence, that makes sense. Because why would anyone want the pnp to determine whether one has a committed a crime, that is a conclusion of law best left to the fiscal. Filing a case merely initiates criminal procedure, but it does not mean it will commence.
