Yeah, I thought he escaped onto the roof, Mission Impossible style, but no, he ran into the parking lot.
Kinda anti-climactic ending. Still interesting, though.
Nal: imo As the situation stands in the video it's illegal. In most states because the victim is able to retreat and the suspect doesnt pose as a threat, even in stand your ground states.
Now if it showed the suspect kicking open the door and attacking the guest then it's stand your ground and/or self defense depending on the state. But the law gets grey when the suspect is retreating. Can't kill people in the back. I think Texas and Florida are the most lenient states for that.
I’m not sure man. I think especially in stand your ground states the phrase “I have a knife” would absolutely be considered a threat and give permission legally to fight the intruder. All speculation though I could be totally wrong.
Nal and I'm not going to act like I know the law but I would imagine it depends on the situation and state law. Different states have different powers especially if there's a grand jury involved.
There was old man in Texas that killed 2 burglars that were breaking into his neighbors house. They tried to escape and he still gunned them down. Grand jury said that was ok with them. Then there's states that will get you for manslaughter at least for the same situation. I think it all falls under are you fearing for your life.

Probably, if what hes doing is considered breach of the peace in the jurisdiction this takes place in, and as well as allows use of force for citizen arrests. Its covered under common law most likely.

I agree, he violated my temporary personal space that I paid for, where I am more vulnerable than in my own home, and stranded with limited resources, clothes and other, and he wants to strip me of that little resources that I have on travel with me... I think Im in full right to beat his ass into oblivion.
I like how this dude was more sensible than the [guy who tried to leap out a hotel window to escape the police.](https://www.youtube.com/watch?v=XwrWlSU3Ju0)
I also like how the person recording was so incredulous that he sounded like Tim Robinson at the end.
["Whh...at? What is going on?"](https://vimeo.com/552164990)
Nah it's on video it wasn't the guests. They cant charge you for what some random criminal does, helps that the guys screamed, "help a burglar" even if he wasn't one with all that on video they are good.
Realistically, what you say happens all the time. Not every crime is prosecuted.
Legally, in most states, you have a duty to retreat when only property is threatened. You can only respond with proportional levels of violence, based on threats to you or others. For instance, if they threaten with deadly force, then you can respond in kind. The threat could just be putting their hand in a pocket, as if to pull out a knife or gun. Some states like Texas permit force to protect property.
But in general, if a robber starts shoving to get past you, you can't just start blasting away.
well, that's what proportional means. Someone shoves you, you can shove them. A punch can get a punch back. But you can't respond to a shove with a knife thrust or a gun shot unless there's some additional context (a shove plus a credible "we're going to kill you, motherfucker" statement).
And (in most states), you can't legally respond to them trying to take your property with a beating. A threat to your property doesn't give you a license to beat them. It happens all the time, but it's not *legal*. Except in Texas and a few other states.
Good info. Next time I get robbed, I’ll be sure to write down their address so I can go steal some of their stuff later on - making sure it’s of equal or lesser value 😂
Brit here. I don't understand the situation (specifically standing there filming it and nothing else). Is there not a "reasonable force" to perform a citizen arrest in the US? Obviously if there's weapons being brandished then yeah, I understand keeping the distance, but apart from talk of knives as soon as Chumpington-Smythe started to exit the window then that guy is getting that top handle used like kiddie reigns and brought back in onto that glass and knelt on.
Also thought, and totally admit ignorance on this, doesn't everyone get the chance to own a firearm and have it at least nearby in a secure location like a car or, if staying in a hotel, your room even if carrying isn't allowed in public? Are hotels like an exception to that? Genuinely no idea and not sure what US legal terms to Google to find out.
With that in mind, if you have a firearm could you not use the threat of it to hold them there until police arrive? Or is it one of those obvious things whereby Chumpington-Smythe knows that if he was fired upon then he can suddenly switch to being victim and so there's no point?
I dunno. Boils my piss that someone would have the fucking brassies to go through my stuff and then tell me how it's going to end by him leaving. It's probably why we prefer to rough them up a bit before Plod turn up. Different cultures I guess. Still, genuinely interested in the American perspective with this video because over here unless we see a weapon we don't believe it, so we're more likely to grab something nearby since then we can't be accused of being "equipped for misadventure".

Did anyone think the room was at a higher floor?
https://preview.redd.it/bkhk57fkhe3d1.jpeg?width=320&format=pjpg&auto=webp&s=dd3cb873d11957672757808239001f28fc2fc03a reminds me of this scene
Funny cause it reminded me of a IASIP scene too. The one where Charlie throws a chair through/out his apartment window.
We were all hoping.
Given the title says Hotel and not motel, yes.
Hotels have first floor rooms, though…and motels have higher rooms, too…
But no Holiday Inn?
Yeah, I thought he escaped onto the roof, Mission Impossible style, but no, he ran into the parking lot. Kinda anti-climactic ending. Still interesting, though.
im disappointed it wasnt
I mean statistically speaking most are.
#JusticeServed
Probably
Odd. Usually burglars stop when you yell "Hey"
Yo!
Hey!
YO!
We got an intruder, a burglar.
We got an intruder, yo! ![gif](giphy|l2JdWEuuIygXKPZFS)
Ah yes Cuban B
HEYO!
MISTA WHITE!!!
We have to cook, kvlt_ov_personality
Disappointed they were on the bottom floor
Is it legal to beat his ass in this situation?

Unless you’re a cop!
What are you talking about? I don't see any dogs to shoot.
I’m not sure man. I think especially in stand your ground states the phrase “I have a knife” would absolutely be considered a threat and give permission legally to fight the intruder. All speculation though I could be totally wrong.
Isn’t the guy recording the one with the knife. I thought the intruder said ‘you have a knife’. And the guy said ‘yeah i have a knife’
What if you just stop them from fleeing so they can be accountable for the property damage they caused?
theyd say listen here cowboy thats not your responsibility or contract as a guest and youre lucky you didnt hurt boiiii

Yes, it's called a citizen's arrest but you better be 100% sure they're guilty.
Just gotta insure everything you own that is valuable. The US sucks.
I imagine if you didn’t film it you could make a case you felt threatened
Find me a DA that would file charges for a little ass whoopin here.

In which state can you beat this guy up legally?
Drunk

that’s all i wanted to happen in this video. plus yeeting him out by his damn backpack. is that the wrong thing to do?!?
I agree, he violated my temporary personal space that I paid for, where I am more vulnerable than in my own home, and stranded with limited resources, clothes and other, and he wants to strip me of that little resources that I have on travel with me... YES
No
Easier to just follow the red drops
Kind of. Slamming and pinning him would be a lawful citizen's arrest.
nah, he just gets away with it. police won’t do anything and civilians can’t, so why not live a life of crime?
[удалено]
Robbing hotel rooms is also wholly unnecessary, so we're already passed that.
![gif](giphy|ap6wcjRyi8HoA)
Forgiveness is important
Typically hotel windows are not operable.
[удалено]
I work in a 3 floor, 94 room hotel and none of our windows open :)
First floor…damn.
Pretty smart really hah. I appreciate that he put so much work into getting the glass out too
Lol, maybe he should’ve yelled some more and he probably would’ve stopped.
I’m sure you would have been calm, cool, and collected in this situation.
lmfao
I mean I would’ve just beat the dude’s ass instead of yelling at him and then called the cops but that’s just me. ☺️
Dude is going to be in a lot of trouble. His face was captured on camera. He will get IDed
We do have a birdler.
That looks like a classy place
Safety first

Intruder gets caught, breaks window in an attempt to escape “Dude, what the fuck is going on?”
And that's why I never get a room on the bottom floor.
Motel
Welp, there goes the security deposit.
Nah it's on video it wasn't the guests. They cant charge you for what some random criminal does, helps that the guys screamed, "help a burglar" even if he wasn't one with all that on video they are good.
This dork has a knife and opted to record.
this shi got me dead, they were both yelling for help
Needed more “YO!”
yo yo yo
Why so dramatic, he could have just opened the window like a normal human being.
Never stay on the first floor.
Hey! Hey, yo! Hey! Hey! Yo! What is.. what.. What is this (looking at broken pieces of the glass window)
Why can’t you just whoop a guy’s ass for stealing your stuff? Are you not allowed to defend your property independent of the threat of violence?

Woah I didn’t say anything about killing someone - just a good ass whoopin’

That dude was just one more shout of YO! away from giving himself up .
why not stop recording, put your phone down and beat his ass?
This is fake. Notice the building is already surrounded by chain link fence.
I think most motels have that fence no?
Batman leaving
If only his hands were free, to do something. Yoyo yo
This is why I like high floors
You dont have to come and confess, we looking for you!
Idk if it’s just me but burglar sounds so outdated now lol. Sounds like a word from the 1800s
That motherfucker should have left that room with nothing but his underwear. You try to steal someones shit they get to steal yours.
It's the Hamburglar™!!
Time to smash. He isn’t leaving that room by his own power.
This guy must have seen that old video of the suspect bouncing off the hotel window and chose the chair to break it haha
Burgler was so calm and had presence of mind.
Jesse pinkman
Maybe he doesn’t understand yolingo
Lmfao
Are we allowed to spank a robber or is that a crime?
I wonder if they are getting their deposit back

Looks like he found a way to come out
Man he would’ve prayed that I wouldn’t tie him up and torture him (I have issues)
Yeah you do. Go to therapy man

How would that work?
Shouldn’ta been lookin at her like that.
