Confusing but sounds like kid that died was one of the kids that broke into home. 4 kids broke in with knives and masks against another four kids. One intruder dies other 3 charged since they were intending to harm.

Updated information regarding the three juvelines that were charged with felony murder in Fraser, MI. The felony murder charges have been dropped, as Trent Redstrom’s death was the result of self defense of one of the juveniles being attacked. Names have been released of the three juveniles arrested and charged: Collin West, Emma Morgan, and Isabella Bridges. They are all still being charged with a 20 year felony for home invasion and Collin is also being charged with two life felonies for assault with intent to murder.

The boy that actually lived in the home was the one who stabbed and killed one of the intruders in self defense. He was held for a week on a murder charge (not sure what degree) before being released after it was proven to be self defense. The three being held right now were intruders along with the boy that died.

Thanks! I guess in that state, the felony murder charge against the other intruders wouldn’t hold up if the killer acted in self defense?

If the kid they broke in with killed someone, that’s felony murder for everyone (because a murder resulted from their commission of a felony). Because the kid they were with got killed in self-defense, there’s no felony murder - because there was no murder.

In some states, defendants have been charged with felony murder when one of their accomplices was killed by a police officer, so I think there’s some nuance in different jurisdictions whether the killing always has to be a murder for people to be charged with felony murder. One recent example involved four teens who fled from the scene of an armed robbery in Arizona. One of the teens was shot and killed by a police officer and the other three teens with him were charged with the murder of the dead teen, even though the police officers who actually killed him were not charged with murder. In that state, the felony murder rule can be applied even if the killing by itself was legal, as long as the court rules that the death was a reasonably foreseeable consequence of the original crime. It sounds like this state has a more restrictive (and IMHO logical) application of the felony murder rule.
