The servers for the 360 and ps3 are still up and the ps3 servers are free and they’re both several years older than the Wii U. Most likely the reality is that Wii U was a flop and they probably didn’t see the justification to keep spending money on it and even tho the 3ds was a smash they probably would rather have people playing the switch

Just like wiimmfi or dolphin, the server emulator powering pretendo was made using the clean room approach, which means there is one party that opened Nintendo's code, looked at it, understood it, then told the other team how it works. That second team then wrote code from scratch to do the same thing they've been told Nintendo's code did - this approach is theoretically completely legal, since the party writing the code has never seen Nintendo's proprietary source code, thus cannot infringe on their copyright.
Nintendo wouldn't be able to sue them anyway, not with any legal stance, clean room reverse engineering of video game products is and has been legal for awhile.

The only issue I have with the fan servers is that the games that I DO care about for are not on the roadmap on their website so there is no telling how much progress there is or if it will be able to get done. I know they ‘intend’ to get it running for everything, but I just tend to lose confidence in fanprojects after having a lot of other ones that I’ve seen just end up stopping partway thru and overpromising.
So until the games that I do want fanservers for are actually up and running (namely XCX) I will still lament the loss of them.
