I worked in worker's comp insurance for 5 years. These companies are no joke. They hire PIs to follow people around every second of the day to catch any hint that the claimant is faking it or at the very least nowhere near as injured as they claim to be.
Literally had a claimant lose their money because they got photographed carrying groceries into their house.
Pro-tip: If you're outside, don't do anything remotely physically taxing. They will see it. You will lose your claim.
Absolutely. I had a few lifetime claims where they were still checking on them years later to see if they could revoke their claim. Insurance companies give no fucks except their bottom line.

That is such a load of bullshit. As someone with multiple chronic medical conditions…. There are days when I feel more or less normal and others I can barely get out of bed. If I didn’t have a WFH knowledge job I’d be on some sort of long term disability/welfare for sure. Trying to work a normal office job would probably see me dead or with an amputation inside of 5 years.
I honestly don't know how disability works but I would hope they'd be more mindful of that kind of stuff. Unfortunately, I wouldn't bet on it. The people in charge of the money are always going to be ghouls.
TBF some of this is contingent on what was claimed during trial. If the evidence before the fact finders in a case like this was that a person might have some function, then seeing them have some function would not overturn the judgment.
This essentially hinges on the company question being able to show the injured party lied in some capacity.
Right but you're not filing a workman's comp complaint. And if you were smart you'd file "I can sometimes have energy to do X". They want to see if you claimed "I can no longer lift or bend!" and then they catch you doing it, without you updating the claim.
A friend of mine does low-level legal work for a firm retained by an insurance company. He said they had a case where a woman was clearly faking it, but the PI only ever found her doing things like going to charity events, helping in soup kitchens or carrying her old neighbor's groceries. They settled because even though she was literally scamming them, they were deeply unconvinced that they could win a jury over to that idea with the evidence available.
The only case of clear fraud I ever saw was a woman who hated her job so much that she set up the stock room shelf to fall on her and tried to claim it was an accident. All the evidence pointed to her literally pulling it down onto herself.
Someone I know was in the middle of a lawsuit claiming disability. Her attorney ended up telling her she needed to remove some posts on FB and stop posting many of her stuff because it could counter her claim. smdh
There are tons of qualifying disabilities that someone could have and when you are dealing with insurance agencies looking to deny claims for any reason, it is absolutely prudent to not give them ammunition. There is a difference between having a broken arm and posting a tiktok video of you doing bicep curls vs. having something like crohns disease and doing the same.
The father of a girl I dated back in 2004 worked for the MTA, and had a bus tire of some sort explode near him, causing ear damage and a host of other things. He was on disability since then, with all kinds of hearing issues/tinnitus.
He was a big muscle car guy and had a couple worked cars, Loud exhaust, etc. He basically needed to not leave the house ever without his ear protection because he had investigators occasionally checking in on him trying to catch him.
