It is absolutely possible that you could have a problem. If you want to be sure he'll need to apply for rehabilitation. Otherwise, yes, they could deny him entry. EDIT: In terms of the border itself yes they will have this information in their system and be able to see it, yes you can count on them asking about it. DUIs are indeed taken seriously. Personally I would not book any kind of vacation or spend any money on plan to visit Montreal without first having filed for and received formal criminal rehabilitation (see the information in your own link). Once you have that, however, you are good to go and have a great trip to a wonderful city!

Thank you for this thoughtful answer!

This is one of those who knows questions. You might get in, you might not, I can tell you 100% how you can make sure you can get in though. File for a certificate of rehabilitation. I had to do this a few years ago for an old crime I got out of high school. There are forms you have to download, fill out and there was a small fee. Once they issue this, it's almost like a punch pass at the border. They don't even ask questions

Firsttimeredditor28

About how long did it take to get approved? I swear it said like a 200 something dollar fee :/

fairlyaveragetrader

Yeah it's pretty cheap, how long it takes is probably going to be variable depending on what a load they have and how in-depth they look into your case. Sooner the better either way

DUI in the USA are state traffic violations. In Canada a DUI is a Federal charge under the Criminal code of Canada. So the short answer is No, your fiance can not enter Canada for ten years after the DUI conviction. After ten years with no further DUI'S, you are deemed rehabilitated. 2 DUI = life time ban. That being said they will only see the DUI if they run a Criminal back ground check in NCIC/CIPIC. And or they ask if you have been arrested. As you do not frequently cross you may get through. Once it is discovered, evertime he/she crosses the system will flag them.

I had one 11 years ago but online it was confusing. Anything more recent you need to fill out the rehab form. Over 10 years do people still need to?

evilpercy

No, if you get pulled over they will run you again and see it has been 10 years. And if no other convictions will make a note in the system that you are Criminally rehabilitated.

Awesome thank you

From my understanding over the years basically it's easy to get into Canada, but your biggest issue is more than likely going to be getting back into the states! Especially if they happen to do a random stop on you. They will absolutely pull your record and then your up shitz creek.

homer_jay84

I think you need a pardon to do it since it's considered a criminal offense in Canada.

Give them a call?? Also just take a trip to buffalo and try to cross and see what happens. I honestly think you’d be fine but definitely just call first.

Firsttimeredditor28

Tbh I didn’t think u could call a government agency lol

Got a family member in a similar situation and one thing I stumbled upon is that if your entry point is an airport Customs Canada knows about your arrival ahead of time and will have done any checks prior to your arrival. Entering through a land port of entry doesn't give them any advance warning, and any checks are much less thorough. Lots of anecotal chatter about being candid if questioned, and that the individual officers have a ton of discretion.

Go to the Canada Border Services site, and read what it says.
